Hi, How Can We Help You?

Labour Market Impact Assessment (LMIA)

Labour Market Impact Assessment

The majority of employers in Canada require a Labour Market Impact Assessment (LMIA) before they can employ a temporary foreign worker. LMIA is an assessment tool used by Employment and Social Development Canada (ESDC) to establish whether the intended employment of a foreign worker will benefit or negatively affect the Canadian economy.

Firstly, the employer must analyze whether they require an LMIA when hiring international talent. The LMIA will confirm three things:

  • You need to employ a temporary foreign worker for your position. In the application, you must show that you could not find a suitable Canadian or permanent resident.
  • The employment of a foreign worker will not negatively affect citizens’ employment rates. You also need to prove recruitment is done domestically.
  • The working conditions, wages, and overall employment terms comply with Canadian standards and cannot exploit foreign workers.

Understanding LMIA Requirements

To receive a positive LMIA, employers must meet certain federal program requirements that may differ depending on the worker category being hired (high-wage or low-wage). However, common requirements include:

  • Advertising the position for at least four weeks on national job sites to ensure Canadian applicants are considered first
  • Ensuring that job demands are realistic and essential for average needs in the occupation
  • The extent to which employers should seek Canadians and permanent residents to fill open positions
  • The extent to which employers should seek Canadians and permanent residents to fill open positions

Challenges of the LMIA Application Process

Before employers can apply for an LMIA, they are required to complete the ESDC application form and other relevant documents. This application is then thoroughly assessed by ESDC to validate:

  • The credibility of the business extending the offer
  • The accuracy of the job title, duties, wages, and working conditions provided by the employer
  • The accuracy of the job title, duties, wages, and working conditions provided by the employer
  • Advertising the position for at least four weeks on national job sites to ensure Canadian applicants are considered first
  • Ensuring that job demands are realistic and essential for average needs in the occupation
